Drunk Driving - OWI/DUI
Under 21 - Wisconsin enforces the Absolute Sobriety Law. If you are under 21 and are caught driving with any alcohol in your system at all, you will receive a $389.50 fine, have 4 demerit points deducted, and have your license suspended for 3 months.
Over 21 - An OWI/DUI citation will be administered if caught driving with a BAC higher than .08.
First Offense: Fine: $150 - $300, License Suspension: 6 to 9 months, Alcohol Assessment is required.
Second Offense: Jail time: 5 days - 6 months, Fine: $300 - $1,100, License Suspension - 12 to 18 months, Alcohol Assessment required, Vehicle: Immobilized or Iginition Interlock Device required.
